Geez

But if it was his tree that fell on your house, surely he´s responsible for letting it grow so close to your house? I think that´s how it is here anyway.
And yes, I know you made that food. It looks great

It isn't close to the house at all; this tree (I found out this huge thing is just a branch off a massive tree in his yard - all the trees around here are between 100-300 foot tall with 30-50 foot branch spans) is at least 30-35 feet long and is 1/3 on his property; laying over both his and my 6' privacy fences; and hanging on powerlines that are about 30' off the ground. The top of the tree with all the leaves and branches is what landed on my deck and roof; which my deck is at least 50 feet off the ground on my property.
So here is the law on it here: IF the tree is diseased; has insect damage; was dead, etc. before it fell; then the neighbor has to pay for it. However, if the tree was healthy and the storm was just so great that it just knocked a healthy tree down; then it is an act of the gods; and our own insurance has to pay for it; minus our deductible.
Well, judging by the healthy pink of the wood inside and the vast amount of green leaves this thing has on it, I am betting it is healthy and removing it and fixing the damage is going to cost us (rather than the neighbors)
