I don't know if they were at that point. But it seems that the piracy going on is on such a large scale that Bethesda might just be trying to hide behind paperwork to avoid dealing with it.

I honestly don't think that Bethesda put any thought into the idea whatsoever. The systems for regulating and moderating mods should have already been in place before they launched the thing. Not only did they not learn anything from the paid mods debacle, but it seems pretty clear that they have absolutely no interest in supporting the modding community.
